Can California Tax You After You Leave? The Wealth Tax Fight Explained

What happens if a state decides to tax your wealth long after you have packed up and moved away?

That question is at the center of a major legal showdown over California’s proposed 2026 Billionaire Tax Act. This ballot initiative seeks to impose a one-time 5% tax on the worldwide net worth of billionaires who were California residents as of January 1, 2026. At TaxDrx, we frequently help clients navigate the complexities of state residency, and this proposal represents a drastic shift in how states might track departing taxpayers.

What the Proposed 2026 Billionaire Tax Would Do

If approved on the November 2026 ballot, the legislation would:

  • Levy a one-time 5% excise tax

  • Target individuals or trusts with a net worth of $1 billion or more

  • Use a January 1, 2026 residency status as the trigger date

  • Tax worldwide assets

According to the California Legislative Analyst’s Office (LAO), this could raise “tens of billions of dollars.” However, the LAO cautioned that triggering an exodus of high-net-worth residents could cause a long-term drop in state income tax revenues.

The Federal Response: Keep Jobs in California Act

In response, U.S. Representative Kevin Kiley introduced the Keep Jobs in California Act (H.B. 7619). This federal bill aims to block states from retroactively taxing a former resident's assets for periods before the tax was enacted.

Why Retroactive Wealth Taxes Matter

Retroactive taxation triggers constitutional debates around due process and the right to travel. California already applies strict domicile tests to determine residency. Trying to pull revenue from former residents will undoubtedly invite fierce litigation.

Furthermore, competing ballot initiatives are surfacing, proposing everything from raising the voter threshold for new one-time taxes to protecting personal savings from new state levies.

The TaxDrx Perspective: Residency Is More Than a Mailing Address

While this specific fight targets billionaires, the underlying principle affects any high-income professional or business owner considering a move out of a high-tax state. Residency audits are incredibly thorough. Whether you live near our Cranford, New Jersey office or work with us virtually across the country, Hudson Etienne and our strategic advisory team emphasize that proactive planning is essential to protect your assets.
